Sales exaggeration means the describing of something(a product or service) and stating it more than it actually is whereas misrepresentation refers to a false statement of material fact made by one party which affects the other party’s decision in agreeing to a contract.A misrepresentation is simply a positive statement of fact, which is made or adopted by a party to a contract which is untrue.”Misrepresentation” differs from “Exaggeration” in the sense that it concerns material facts and information. For example,a furniture store plastered a sign all over the showroom saying, “Blowout Sale,” only to find that the discounts being offered are minimal which shows exaggeration as well as misrepresentation as a sale is really taking place even if it is small.
